Competition Terms and Conditions

Last updated: 17 May 2024

This competition is a Game of Chance. By purchasing an order through the PayPal gateway between 12am AEST on the 1 June 2024 and 11.59pm AEST on the 30 June 2024, you are automatically in the draw to win $1,000 AUD. 1 winner will be drawn to receive $1000. 3 runners up will receive prizes of $500 each. Participation in this Competition is deemed as acceptance of these Terms and Conditions.

Who is the promoter?

The promoter is Humanitix Limited (ABN 32 618 780 439) (‘the promoter’), working in collaboration with PayPal Australia Pty Limited (ABN 93 111 195 389) which offers the PayPal service and holds AFSL 304962 (see paypal.com/au for details). PayPal is not responsible for promotions offered by third parties and you should read these terms and conditions.

Who can enter?

Entry is open to residents of Australia aged 18 years or over only, who are purchasing tickets on the Humanitix platform for events transacting in AUD. You can enter as many times as you like by placing an order between 12am AEST on the 1 June 2024 and 11.59pm AEST on the 30 June 2024.

Employees of the promoter and PayPal and their immediate families, suppliers, associated companies and agencies are ineligible to enter. Persons under the age of 18 years are not considered adults and therefore are not able to enter. If a winner is discovered to be under 18, they will automatically be disqualified.

The prize draw will take place at 1-5 Hickson Road, The Rocks, NSW 2000 on 1 July 2024.

Entrants do not need to be physically present. Orders completed via PayPal will be entered into the draw. Each order is considered an entry. The number of tickets placed within an order does not increase the number of entries.

The first randomly drawn valid entry is the winner of $1000. The next 3 randomly drawn valid entries are the winners of $500 each.

Any entries that do not meet the entry criteria above will be deemed as an invalid entry, and the promoter will disregard invalid entries.

To be valid, entries must have purchased ticket(s) through the Humanitix platform using PayPal as the method of payment in AUD and the status of the order must be complete and not cancelled, refunded or swapped at the time of the draw.

Notice & prize collection

The promoter will notify the winners by email within 48 hours of the draw occurring. The prize will be delivered via direct debit to the winners within 4 weeks of notification of winning, provided the accounts are Australian bank accounts. Winners must provide their Australian bank account details to transfer the prize into. Prizes are not transferable.

If 3 months after its award any prize remains unclaimed for any reason (including because the promoter was unable to deliver it or the winner failed to collect it) then on 1 October 2024 the promoter will re-draw and add the next eligible entrant with a valid entry will be drawn.

This will occur at 1-5 Hickson Road, The Rocks, NSW 2000. Previous winners of unclaimed prizes are not eligible for the re-draw. This process may be repeated as often as necessary until no prizes remain unclaimed.

The promoter is not responsible for contacting the winners by any other method or for the winners not receiving notification for any reason. Entrants are responsible to provide and maintain correct contact details.

Cancellation or change

The promoter may modify, suspend, terminate or cancel the Competition if for any reason (including interference or a breach of these terms) it cannot conduct the Competition as reasonably anticipated or if the fairness of the Competition would be compromised.

Except for any liability that cannot be excluded by law, the promoter (including its staff and agents) excludes all liability (including negligence) for any personal injury, illness or death or any loss or damage (including loss of opportunity) whether direct, indirect or consequential, arising in any way out of the Competition or any prize, including where arising out of the following

  • Any technical difficulties or equipment malfunction (whether or not under the promoter's control) including inaccessibility of any website;
  • Any theft, unauthorised access or third party interference;
  • Any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the promoter) due to any reason beyond the reasonable control of the promoter;
  • The use of a prize; or
  • The award of a prize to an ineligible entrant.

Entrant’s costs

Any cost associated with lodging an entry (including internet costs in accessing the Competition website) is the entrant’s responsibility. Any costs incurred in receiving, collecting or using a prize is the entrant’s responsibility, including travel, accommodation, and tax liability.

Privacy notice

The promoter collects entrants’ personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including prize suppliers. Entrants must provide their personal information otherwise their entries will be invalid. The promoter may use the entrant's personal information for promotional, marketing and publicity purposes in connection with the Competition including sending electronic messages or telephoning the entrant. Personal information will be stored by the promoter at its address and entrants may contact the promoter to access or correct it.

Entrants agree that if they win any prize, they will co-operate with the promoter in providing the story of their win, including being interviewed, photographed and filmed. Entrants consent to the promoter using the entrant's entry, name, likeness, and image in any media for an unlimited period without remuneration in connection with the Competition or the purposes of the Competition. Winning entrants agree that they will not provide their story to any media organisation without the promoter's prior written consent.

Interference & unfair advantage

Entrants must not attempt to interfere with or undermine the operation of the Competition or interfere with the normal functioning of any website the Competition uses or attempt to obtain any unfair advantage or undermine the operation of the Competition including using any macro, program, series of commands, system or electronic or mechanical device that enables entries to be lodged automatically or repetitively.

Disqualification & removal

The promoter may disqualify an entry if it reasonably suspects unlawful or improper conduct. Such improper conduct can include:

  • Infringing the promoter’s and/or PayPal’s intellectual property rights; or
  • A breach of the competition terms and conditions.

These terms will be construed according to the laws of New South Wales and entrants submit to the exclusive jurisdiction of the courts of that State. “Including” is not a word of limitation. Failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Unless otherwise provided for under applicable laws, governmental regulations, orders and requirements, these Terms and Conditions are subject to change without prior notice.
